Zimmer Ordered To Respond to Complaints Over Durom Cup Hip Replacement Devices

All federal lawsuits against Zimmer Durom Cup hip replacements have been consolidated in the U.S. District Court for the District of New Jersey as part of a multidistrict litigation. Proceedings were stayed while settlements continued. At least seven lawsuits were not settled, and discovery will now continue, which allows the parties to exchange information and prepare for trial.

The Zimmer Durom Cup hip replacement device was supposed to prevent general problems like instability, limited range of motion and bearing wear. However, after being introduced in the U.S. in 2006, and after about 12,000 implants were performed, concerns over the number of people who needed revision surgery due to component loosening arose.

Zimmer issued a temporary recall of the Durom Cup in July of 2008, to implement revisions to product warnings and instructions. At that time Zimmer estimated a 5.7% failure rate, however it has been suggested that the 20% to 30% of patients may experience problems with the Durom Cup.

A status conference regarding the consolidated lawsuits will be held on June, 29, 2011. Zimmer has reportedly set aside $75 million to resolve current and future lawsuits.
