Zimmer NexGen Knee Lawsuit Consolidation Requested

A request to consolidate all Zimmer NexGen knee replacement device lawsuits to the U.S. District Court for the Northern District of Illinois was filed earlier this month by plaintiff Fred Stone. More than 28 lawsuits are pending in federal courts across the United States, and attorneys suggest that hundreds more are waiting in the wings.

The lawsuits allege that Zimmer downplayed and understated problems with the devices despite having knowledge that some   Zimmer NexGen CR-Flex femoral components, Zimmer NexGen MIS tibial components, and Zimmer NexGen LPS-flex femoral components failed before their expected lifespan, causing problems for those who had the devices implanted, including problems walking, permanent injury and complicated revision surgery to replace the faulty devices.

Consolidation of all Zimmer NexGen knee replacement lawsuits before one judge in one court during pre-trial proceedings in Multi-District Litigation (MDL) means that pre-trial proceedings are handled much like a class action, however each lawsuit remains individual, to be heard and ruled on based on its own merits.
