Zimmer Files Lawsuits Against Law Firm Over NexGen Advertisements

Zimmer Holdings, makers of the NexGen knee replacement systems, has filed a lawsuit in U.S. District Court for Southern Ohio against the Ohio law office of Elk & Elk Co., over television and internet advertisements that the company claims make false and defamatory statements about its knee replacement products.

The lawsuit claims the ad campaign states the NexGen replacement system “has a high failure rate, causes pain, has resulted in the recall of the NexGen CR-Flex product and is otherwise defective.” Zimmer said in the lawsuit that the law firm “made these statements knowingly, in order to attract potential clients for personal injury cases.” Zimmer also said in the court filings that its product has “among the lowest rate of revision in national joint replacement registries around the world.”

Zimmer filed a lawsuit in the U.S. District Court for Northern Indiana against three law firms who ran similar ad campaigns against NexGen knee replacement systems.

The lawsuit seeks a jury trial, “actual, presumed, special, and punitive damages,” injunctions barring further defamation, pre- and post-judgment interest, and a order that the law firm run ads that correct any misleading statements and an apology over the firms unlawful conduct.
