Wrongful Death Lawsuit Filed over Tainted Eggs

The son of Mate Marlais, 89, has filed a wrongful death lawsuit in Alameda County Superior Court against Wright County Egg farm and El Rancho Steakhouse claiming that Marlais died from salmonella-tainted eggs grown at Wright County Egg and served by El Rancho Steakhouse.

According to the lawsuit, Marlais was found “lying in a pool of diarrhea” just days after he ate over-easy eggs at El Rancho on June 7, 2010. He was rushed to the hospital in the state of shock, and died a short time later, after being removed from life support. More than 1,300 people across the country had been hospitalized after eating eggs from the Galt, Iowa farm, though Marlais was reportedly the only who died from them. Nearly half a billion eggs were recalled over the salmonella contamination.

The lawsuit says that both the farm and the restaurant are responsible and liable for the death of Marlais, as they were negligent in ensuring the eggs were not contaminated.

The lawsuit seeks unspecified monetary damages from Wright County Egg and El Rancho Steakhouse.
