The national law firm of Parker Waichman LLP has filed a wrongful death lawsuit on behalf of the estate of a New York woman who died while a resident of the Our Lady of Consolation Geriatric Care Center in West Islip, New York. The lawsuit was filed in the Supreme Court of the State of New York, County of New York, and alleges negligence caused her death.
According to the lawsuit, the plaintiff was a resident of the nursing home from December 2008 to May 16, 2011, when she fell and fractured her left tibia and fibula, allegedly because of the negligence of the facility. The plaintiff died on May 22, 2011 from complications of her injuries.
Parker Waichman LLP Nursing Home Abuse & Neglect attorney Brett Leitner said, “One of the largest causes of potential preventable hospital emergency room visits made by nursing home residents is injury due to a fall. This is all the more reason that nursing homes must be vigilant about keeping the facility free of dangerous conditions that might cause an elderly patient to slip or trip and fall, and must provide proper safety devices, supervision, and interventions to prevent falls from occurring.”
The lawsuit seeks among other things, compensation for punitive damages.
