Wrongful Death Lawsuit Filed Against Maker Of Avandia

Jason Mark Knight, Janice East and Janet Knight have filed a wrongful death lawsuit against Smithkline Beecham Corp., and Glaxosmithkline  in the Marshall Division of the Eastern District of Texas. U.S. District Judge T. John Ward will preside.

James Michael Knight started on Avandia in April 2005 and died from a heart attack in April of 2009. His family is accusing the drug manufacturer of knowing the serious and adverse side effects of the drug and failing to adequately warn users of those risks.

Knight’s family is accusing Smithkline Beecham Corp., and Glaxosmithkline of negligence and strict products liability for

  • failing to perform adequate and proper testing and inspection of the drug
  • failing to use a reasonably safe design
  • failing to manufacture the drug in a safe condition

The family seeks survivor damages, wrongful death damages and punitive damages.
