The national law firm of Parker Waichman LLP has filed a lawsuit in the Superior Court of New Hersey, Atlantic County Law Division against Merck Sharp & Dohme Corp., Merck & Co., Inc., and other companies who manufacture the osteoporosis drug Fosamax. The lawsuit was filed on behalf of a woman who took Fosamax and subsequently suffered a femur fracture.
According to the lawsuit, the plaintiff began taking Fosamax as prescribed in December 2004 and suffered a femur fracture in September 2009. The plaintiff alleges that she would not have used Fosamax if the defendants had adequately warned about the risks associated with the medication, especially since safer alternatives exist.
The lawsuit also alleges that the makers of Fosamax failed to conduct sufficient post-marketing surveillance of the osteoporosis drug after it was on the market.
The lawsuit seeks damages for severe mental and physical pain and suffering, permanent injuries, emotional distress, and economic loss due to medical expenses and living related expenses due to a new lifestyle.
