Water Treatment Company Charged With Falsifying Water Test

Theodore and Stacey Sawyer of Naples filed a lawsuit against Yarmouth-based Water Treatment Equipment Inc., and Culligan International Co., in Cumberland County Superior Court alleging that Water Treatment Inc., falsified water test results to show satisfactory levels of uranium when in fact, later tests showed levels of uranium in the water was seven times higher than recommended levels.

The lawsuit says that the Sawyers purchased a Culligan water system from Water Treatment Equipment in April 2008, to remove the uranium from their water. In August 2009, after putting their home up for sale, they discovered the falsified reports.

The lawsuit charges Water Treatment Equipment with violating Maine’s Unfair Trade Practices Act, as well as fraud, negligence, and intentionally inflicting emotional distress, breach of contract and breach of warranty.

The lawsuit seeks damages for emotional distress, costs for medical monitoring and diminution of value of the home.
