Washington State, Day Care Sued Over Death Of 4-Year-Old E. coli Victim

Anthony  and Bonnie Wilson have filed a lawsuit against the Fletch Family Day Care, Larry and Diane Fletch, day care operators, Clark County, and the state of Washington, alleging each defendant is responsible for the wrongful death of their 4-year-old son, Ronan who died April 8,2010, one week after contracting E. coli from the in-home day care center.

According to the lawsuit, the day care had violated state laws several times for the number of children it was responsible for, that the Fletches did not take reasonable precautions against the transmission of communicable diseases, and that “Fletch did not maintain their home and all child care equipment in a clean and sanitary condition, which contributed to the person-to-person spread of E. coli.”

Though the county learned of the first case of E. coli in March, they did not close the daycare until a month later, after it found that more people had been infected though they were showing no signs. The suit alleges the “negligent failure of the Clark County Public Health Department to reasonably alert the medical community, the general public or the public schools of the E. coli outbreak in a timely manner caused or contributed to the death of Ronan A. Wilson.”

The lawsuit seeks an undetermined amount in damages for funeral expenses, loss of future earnings, and “pain, suffering, anxiety, emotional distress and fear of impending death experienced by Ronan,” the Columbian reported the lawsuit as saying.
