Villaspring Nursing Home Not New To Lawsuits

Villaspring Health Care Center of Erlanger, Kentucky is currently being sued by the U.S. Attorney for the Eastern District of Kentucky, Kerry B. Harvey for neglect of patients from 2004 to 2008, and Medicare and Medicaid fraud because they billed $16 million for “worthless” services  and care so “grossly deficient” it lead to patient deaths.

However, according to Cincinnati.com, the nursing home has been involved in previous lawsuits, in which is settled out of court. One lawsuit was a wrongful-death case, and another was a negligence care claim. A third lawsuit, a wrongful death claim, was dismissed because the plaintiff failed to follow up. The conditions of the settlements were not made public as the plaintiffs signed nondisclosure disagreements.

Though the nursing home has not responded to the federal lawsuit in court, Villaspring parent Carespring Health Care Management CEO has denied the fraud claims filed by the government. However, if the nursing home is found guilty, they would face $5,500 to $11,000 in penalties per false claim, and have to repay Medicare and Medicaid three time the amount charged to the agencies for fraud, Cincinnati.com reported.
