Urine Testing Company Targeted In Department of Justice Investigation

A whistleblower lawsuit filed in Massachusetts federal court in 2009 against Millennium Laboratories of San Diego alleging fraudulent billing practices is currently being investigated by the Department of Justice. The allegations extend to the thousands of physicians and facilities serviced by Millennium who “knew or should have known” about the fraudulent billing.

The lawsuit was filed by the late Robert Cunningham, an attorney who, according to the complaint, “spent a portion of his time acting as the compliance officer for a laboratory in Massachusetts which competed with Millennium,” Main Justice reported. The lawsuit alleges that Millennium encouraged physicians and other health care providers to bill governmental health programs including Medicare and Medicaid, for drug testing services that weren’t provided. Millennium performs urine testing of those who are prescribed opioids and other prescription pain medications.

According to the lawsuit, the fraud brought Millennium and the doctors involved big profits from urine testing and medical billing. An example reported by Main Justice is that Millennium allegedly told doctors that if they billed 20 tests a day, they would earn $2.3 million a year, and that doctors were encouraged to bill for multiple tests, even if only one was performed.

False Claims Act whistleblower lawsuits are sealed while the government investigates the claims and decides whether to join the lawsuit, however, the suit was unsealed after the government failed to meet a previously determined February deadline. The DOJ will continue to investigate the case. If the government declines to join the suit, the law firm that filed the lawsuit on behalf of Cunningham’s estate can continue to pursue the case on their own.
