According to recent court documents, the number of people who have filed lawsuits in federal court against DePuy over the ASR hip replacement system has surpassed 2,600, with nearly 20 new lawsuits being filed every day.

Lawsuits filed against DePuy over the ASR hip implant in federal courts across the US have been consolidated in the US District Court for the Northern District of Ohio as part of multidistrict litigation.

According to some estimates, over 37,000 US residents had received the DePuy ASR system before a recall was issued in August 2010 after data showed that the hip implant had an abnormally high failure rate.

The consolidated lawsuits all claim that DePuy Orthopaedics inc., and parent company Johnson & Johnson, designed and sold a defective product, failed to adequately warn consumers about the risk of catastrophic failure, and failed to warn patients about the increased risk of metal poisoning caused by the device shedding cobalt and chromium particles into the body.

The number of lawsuits being filed against DePuy is expected to continue to grow, as many patients who were hoping for settlement offers from the Johnson & Johnson subsidiary, are electing to turn to attorneys for help.
