Texas Athlete Files Lawsuit Against DePuy Over Recalled Hip Implant

Houston residents Charlotte and Jeremy Mustard have filed a lawsuit in United States District Court for the Northern District of Ohio – Western District against DePuy Orthopaedics, Inc., DePuy Inc., DePuy International, Ltd., Johnson & Johnson, Inc., Johnson & Johnson Services, Inc. and Johnson & Johnson International, Inc., alleging that the DePuy ASR Hip Resurfacing System has devastated the quality of her life.

The lawsuit claims that Charlotte, a competitive swimmer and former world record holder, had the DePuy ASR device implanted in her left hip at the age of 39 due to osteoarthritis caused by years of swimming.   According to the press release issued by her attorney, Charlotte has “suffered severe and debilitating injuries, including hip pain, stiffness, twinges, heart palpitations and vision problems…and is  deeply concerned about her long-term health and is devastated over the impact on her quality of life.”

DePuy ASR Hip Resurfacing System and the DePuy ASR Acetabular System were included in a recall issued on August 24, 2010, because of device failure, component loosening, infection, dislocation, bone fracture, and increased metal ion levels in the blood.

An attorney for the lawsuit said in the press release that “”The testing of the ASR system was completely inadequate. ” He also said that “[t]he design of the ASR was fundamentally flawed which has led to disastrous consequences for Mrs. Mustard and thousands of other patients.  This never should have happened to Mrs. Mustard and could have been avoided if the device was safe and effective as promised.  Medical devices should improve a person’s quality of life, not limit it.”
