Tech Support Sues Law Firm Over Wages

A class action lawsuit has been filed by seven desktop support technicians  against Schulte Roth & Zabel, a Manhattan law firm, alleging the firm violated the federal Fair Labor Standards Act by not paying overtime wages. The Fair Labor Standards Act says that employees must receive no less than one and a half times their normal wage for every hour worked over 40 hours.

The class action lawsuit was brought by Keith McKenzie, who worked for the law firm for nine years, on behalf of  seven others who worked as desktop support technicians over the last three years. The lawsuit alleges that the firm instituted a policy that gave support technicians extra time off, instead of overtime wages for every hour they worked over the normal work week.

Gary Fiebert, the firm’s executive director said the lawsuit is “without merit”, and said the firm will respond to the allegation in court.

The lawsuit is seeking class certification, unpaid overtime wages with interests and penalties, and is asking the court for an order that will prevent the firm from violating federal labor laws in the future.
