Secret Company Files Lawsuit Against Government Agency To Squash Safety Complaint

An unnamed firm has filed a lawsuit against the Consumer Product Safety Commission in an effort to prevent the government agency from releasing a complaint reported on about a product that allegedly hurt a child. The unnamed firm has also requested a Maryland federal court to seal all court documents concerning the lawsuit, because allowing the documents to be seen by public would effectively be the same as making the complaint public.

Consumer advocacy groups Public Citizen, with the Consumer Federation of America and the Consumers Union have filed an objection with the court, requesting the motion to seal the case be denied. was created as a result of the Consumer Product Safety Improvement Act passed in 2008, as an easier way for consumer to research products and services. Standard procedure for the site is to give businesses 10 days to respond to a complaint before it is published on the web.

“If this company is allowed to keep a report of a potentially hazardous product out, it would effectively undermine a tool that Congress ordered created to protect consumers,” Public Citizen staff attorney Scott Michelman said.
