Second Lawsuit Filed Against DuPont Over Imprelis

A second class action lawsuit has been filed in U.S. District Court for the District of Delaware by a homeowner and Indiana golf course, against DuPont alleging that the company was reckless or negligent for putting the herbicide Imprelis, which is killing the trees, shrubs and ornamental plants , on the market.

According to the lawsuit, the herbicide Imprelis was approved by the EPA last October, and was marketing as a low-impact herbicide for professional use on lawns, golf courses, schools, parks and sod farms. While effective at killing what it was marketed to kill, the product also seems to be killing willows, poplars, and conifers, and other shrubs and trees that have a shallow root system.

The lawsuit alleges that DuPont was either negligent  in testing the product, or reckless in bringing the product to market, and that DuPont failed to provide customers with adequate warnings about the potential of the chemical to migrate through the soil to shallow root systems.

The lawsuit seeks compensation for all property damage caused by the application of Imprelis and an injunction to stop DuPont from selling the product and unspecified punitive damages.
