Possible Lawsuit in Darian Lake Roller Coaster Death

Lawyers now involved in the investigation of the death of Army Sergeant James Hackemer who was thrown from the Ride of Steel roller coaster at Darien Lake Theme Park on July 8, 2011. Sergeant Hackemer had lost both of his legs in Iraq in 2008 due to a roadside bomb.

According to WGRZ 2 On Your Side, a law firm has been asked to assist in the investigation of the coaster accident, and has requested news footage from coverage of the accident, but they will not disclose who hired them.

The park spokesperson also said they could not provide any information as to who is bringing the lawsuit. The Hackemer family initially said they would not bring suit against the park as it was James’ decision to get on the ride. The family continues to say they have not brought suit.

According to an attorney who worked on a similar case in which a man fell from the same ride in 1999, the park had the ultimate responsibility over the ride, even though Hackemer wanted to go on the ride. Since the park did not refuse him, they are not absolved from responsibility.
