Ohio Woman Sues DuPont Over Imprelis

Luanne Miller, Cleveland, has filed a lawsuit in U.S. District Court in Cleveland against Imprelis herbicide maker DuPont alleging the chemical, which is marketed as a state of the art, and environmentally friendly, killed several conifer trees on her property. Imprelis has been hit with a wave of lawsuits as several class-action lawsuits have been filed in Delaware court in recent weeks, according to Cleveland.com.

An attorney for the plaintiff said that “in its relatively short time on the market, Imprelis has proven to be a frighteningly effective tree killer,”  and that he would try to have all lawsuits consolidated in an Ohio court because it “appears that Ohio may very well be the epicenter of Imprelis’ destruction because it was so widely used all over the state,” the Cleveland blog quoted.

The most common trees being affected by the herbicide are the Norway Spruce, white pine, willows and poplars. Experts have estimated that current damages could run to the hundreds of millions dollars.

The EPA is currently investigating Imprelis and had requested data concerning the herbicide from DuPont’s own investigations.

In her lawsuit, Miller is accusing DuPont of fraud and negligence.
