O’Charley’s Being Sued For Overtime Issues

A lawsuit has been filed in Nashville Tennesse against O’Charley’s Inc., alleging that the company changed the number of hours worked and “regularly and consistently”  forged signatures of employees so they could avoid paying overtime.

The lawsuit, brought by O’Charley’s server, Ashley Puckett claims that the payroll records of her and several other employees were edited, and overtime hours removed.

Bob Luz, vice president of human resources and training at the Nashville-based food chain issued a statement saying “O’Charley’s, Inc. has consistent corporate policies and controls across its restaurants to ensure that employees are fairly and legally compensated, and takes that responsibility very seriously. Due to the legal nature of these allegations, the company is unable to provide additional comment at this time.”

Under the Fair Labor Standards Act, if Puckett wins the lawsuit, she will only get twice the amount of back pay earned and her overtime wages plus legal fees.
