No Defense in $200 million Nursing Home Verdict

The estate of Elvira Nunziata has been awarded $60 million in compensatory damages and $140 million in punitive damages after her son filed a lawsuit against Pinellas Park Care and Rehabilitation Center, a nursing home in Tampa Bay, Florida. The nursing home was managed by Trans Health Management, and was accused of not doing enough to prevent Nunziata from a fatal fall.

According to the lawsuit, Nunziata was missing from a group of residents for over an hour before staff started to look for her. She had fallen down a flight of stairs while strapped into her wheelchair. She died shortly after paramedics arrived at the scene, the Tampa Bay Times reported.

At the trial, former employees testified that the nursing home was understaffed, and that Nunziata had fallen and suffered other injuries and illnesses prior to the fatal fall. Staff also testified that the stairwell door should have been locked at the time, but that employees often unlocked the door and disabled the alarm so they could slip out to smoke.

The verdict is one of the largest nursing home abuse awards ever. News sources also reported that the courtroom was void of defense attorneys, as none appeared to defend Trans Health Management, Inc.
