Nebraska Beef and Meyer Natural Foods Reach Settlement In E. Coli Lawsuit

An agreement between Nebraska Beef Ltd., and Meyer Natural Foods LLC. has been reached in  a lawsuit filed in 2009 over which company was liable for E. coli-tainted meat.

Nebraska Beef sued Meyer in order to determine which company should be held liable after nearly 7 million pounds of beef were recalled in 2008 because of E. coli contamination. At least four lawsuits were filed against Nebraska Beef after the recall.

The lawsuit stated that Meyer had wanted Nebraska Beef to indemnify it against liability for the contaminated beef, but Nebraska Beef denied the contamination originated its processing plant. At least some of the recalled beef came from cattle Meyer purchased and shipped to the Nebraska Beef processing plant from May through July 2008. Nebraska Beef also denied that it had breached the terms of its contract with Meyer. Determination of where the contamination occurred was hindered because much  of the recalled beef had been shipped off for further processing.

The court ordered both companies to file a motion to dismiss the lawsuit. Settlement terms were not disclosed.
