Mother Files Lawsuit over Tainted Pine Nuts

Kimberly Waterbury of Webster, New York, has filed a lawsuit against American Pistachio Commodity Corp., dba Sunrise Commodities of Englewood Cliffs, NJ, on behalf of herself and her child became sick after eating pine nuts tainted with salmonella. The Centers for Disease Control and Prevention has reported that 42 people across five states have become sick with salmonella poisoning from the pine nuts.

The pine nuts in the Waterbury case were purchased from Wegmans Food Markets. According to the FDA, Wegmans recalled the pine nuts on October 26, and that Badia Spices of Miami had recalled 3,800 pounds of Turkish pine nuts from Sunrise Commodities. The FDA then announced on November 9, that Sunrise Commodities was recalling 21,000 pounds of pine nuts after they were confirmed to be tainted with salmonella.

The lawsuit seeks an unspecified amount in damages, and charges Sunrise Commodities with strict liability, negligence, failure use reasonable care in the manufacture, distribution, and sale of the pine nuts, and for violation of state, federal, and local food safety regulations, the Democrat and Chronicle reported.
