Mold Lawsuit Decision Overturned in New York

Four years ago in New York, a Manhattan appellate court ruled that scientific evidence that illness caused by mold in buildings was in dispute, squashing a multimillion-dollar damage lawsuit.

Recently, a five-judge panel in the same court overturned that decision based on scientific evidence that now says mold in building is “indicative of a causal relationship.” According to the Wall Street Journal, the previous decision ruling did not rule out the possibility that “dampness and mold can ever be considered the cause of disease.” The new ruling was made after several studies added to evidence based on the theory of moldy building affecting health.

Bill Sothern, a certified industrial hygienist, and founder of the mold inspection and consulting company Microecologies, said the decision “is going to result in a heck of a lot more lawsuits being filed by people who have mold- and moisture-related conditions and suffer from health effects.”
