The family of Paul A. Schwarz has filed a wrongful death lawsuit against Jensen Farms and tainted cantaloupe distributor Frontera Produce claiming Schwarz, 92, developed listeriosis and died after eating the fruit.
According to the original lawsuit, Schwarz developed listeriosis in September, spent five weeks in the hospital, and was in a nursing home when the lawsuit was filed in October. Schwarz died on December 18, 2011. The lawsuit was originally filed as a damage suit; however, it was amended to a wrongful death lawsuit after Schwarz died. The lawsuit was filed on behalf of Schwarz’s son, Paul F. Schwarz of Independence, Missouri, the Kansas City Star reported.
This past fall, federal health investigators linked cantaloupe from Jensen Farms in Colorado to a listeriosis bacterial infection outbreak that made 146 people sick, and caused the death of 31 people, including Schwarz, and is to blame for at least one miscarriage.
