Merchants File Lawsuit against Groupon

BidMyCrib.com has filed a lawsuit against Groupon Inc in Chicago federal court alleging the daily deals web company violated the Stored Communications Act by altering emails “in electronic storage.” BidMyCrib.com has requested class action status for the lawsuit, on behalf of Groupon’s merchant clients, Bloomberg reported.

Groupon was founded in 2008 and offers daily restaurant, business, service, retail, and hotel discounts to subscribers. The lawsuit accuses Groupon of altering email agreements with merchants after the terms of the agreements were accepted.

Groupon corresponds with merchants through email and transmits merchant agreements in the body of the email. According to the lawsuit, Groupon goes back through the accepted email agreements and changes the accepted terms.

The lawsuit says that Groupon changed as least one section of BidMyCrib’s agreement by adding in a sentence that changed voucher expiration dates of terms that had previously been agreed upon. Bloomberg defined BidMyCrib as a website that allows contractors to bid on residential construction projects.

Groupon has declined to comment on the case.

In addition to class action status, the lawsuit seeks unspecified damages.
