Lawsuits Continue To Be Filed Against Imprelis Maker DuPont

To date, at least four lawsuits have been filed against DuPont for its Imprelis herbicide which is alleged to be killing trees across the country.

The first lawsuit was filed by Michigan plaintiffs, Washtenaw Acquisitions, Polo Fields East and Polo Fields Golf and Country Club. The second and third lawsuits were filed by three Pennsylvania residents and an Indianapolis company with golf courses in the area. The fourth lawsuit was filed by another Pennsylvanian who alleges he has lost seven trees after his landscaper treated his property with Imprelis in May.

All of the lawsuit have been filed in U.S. District Court in Wilmington, Delaware, and one of the plaintiff’s attorneys feel the lawsuits could be combined. The lawsuits all allege that, among other things, DuPont is guilty of consumer fraud, negligence and land damage. The Detroit Free Press has reported that unnamed experts believe the damage could reach into the millions.

The Detroit Free Press reports that DuPont spokesperson Kate Childress has said in response to the allegations that DuPont is …”working with our customers to investigate reports of unfavorable symptoms observed on certain tree species, primarily Norway spruce and white pine. We are evaluating our response to the complaint, but are confident that this purported class-action lawsuit is unfounded, and we will oppose it vigorously.”

DuPont is conducting investigations into the accusations, and the EPA told the Free Press they will launch and expedited review by the end of this month based on investigations across several states and reports by DuPont.
