Lawsuit To Prevent New York Forest Fracking Filed By Coalition

A lawsuit filed by the Croton Watershed Clean Water Coalition Inc., in the New York State Supreme Court in Kingston, declares that horizontal hydraulic fracturing in state forests goes against the state Constitution and environmental laws.

The lands in question are the Stewart State Forest, and forest lands in Ulster, Delaware and Greene counties. The attorney for the plaintiff said that the defendant, the Department of Environmental, Conservation has rejected many industrial propositions in state forest lands including wind turbines, utility lines, mining and the Coalition feels that hydraulic fracking should be rejected also.

The plaintiffs in the lawsuit said the state has corrected the damage done by years of industrialization in forest areas, and that to allow fracking now “will reverse those gains, allowing industry to profit over people,” adding that “radioactive discharges will threaten human health for centuries.”

Marcellus Shale formation can be found under the lands in questions, are ripe for horizontal drilling, which entails blasting water, sand and chemicals deep underground to release natural gas from the shale.
