Lawsuit Filed Against Frito-Lay over All-Natural Claims

Richmond, California resident Julie Gengo has filed a class action lawsuit in the Central District Court of California against PepsiCo snack unit Frito-Lay over claims made by the company that some of its Tostitos and SunChips products are made with all natural ingredients.

The lawsuit claims that Frito-Lay is misleading consumers because the products are made with genetically modified corn and vegetable oils. “The reasonable consumer assumes that seeds created by swapping genetic material across species to exhibit traits not naturally theirs are not ‘all natural.”

The Huffington Post reports that the case will be a difficult one as the FDA defines “all natural” as “ingredients extracted directly from plants or animal products as opposed to being produced synthetically.”

The FDA issued a regulation in 1993 saying that is not misleading to market a food as all natural if “Nothing artificial or synthetic (including color additives regardless of source) has been included in, or has been added to, a food that would not normally be expected to be in the food.”
