Lawsuit Filed Against Clark County Public Health Over Day Care Death

Bonnie  and Anthony Wilson, parents of 4-year old Ronan Wilson have filed a lawsuit against the Clark County Public Health department in Washington state alleging that negligent failures by the county were causes of Ronan’s death, after he contracted E. coli at the Fletch Family Daycare center.

The lawsuit alleges that the health department was negligent and didn’t “reasonably alert the medical community, the general public or the public schools of the E. coli outbreak in a timely manner.”

The lawsuit also states that “Despite the knowledge of three children from the Fletch Family Daycare having contracted E. coli and the knowledge that Fletch Family Daycare was not following proper diaper disposal procedures and was not taking proper precautions against the spread of a communicable disease, the Clark County Public Health Department did not notify or otherwise alert the medical community, the general public or the public schools of this outbreak.” Not knowing about the E.coli outbreak, Ronan’s doctor diagnosed his illness as the flu.

23 children and four adults contracted E.coli during the outbreak. Four children, including Ronan were hospitalized. Ronan was in the hospital for a week before he died.

The state Department of Early Learning revoked the day care’s license because they did not contact the county health department for 10 days and continued to operate the day care after children started to become ill.

The lawsuit seeks financial damages of an undetermined amount.
