Lawsuit Claims Google Failed To Pay Overtime

A lawsuit has been filed in Iowa Southern District Court against Google Inc., Mainelli Mechanical Contractors, Inc., and Eurest Services, Inc. by Michele A. Peterson for failing to pay overtime wages. Peterson, of Papillion, Nebraska, said she worked 50-60 hours a week at Google’s Council Bluffs data center in Iowa and was not paid overtime “to complete the work demanded by Google’s management.”

The lawsuit claims that Peterson was a non-exempt employee while she worked at Council Bluffs from January 2008 to February 2011, and non-exempt employees are entitled to overtime pay according to the Fair Labor Standards Act.

Though the lawsuit states that Peterson was a facility coordinator for Google, a receptionist for Mainelli Mechanical Contractors, Inc. said that Peterson worked for them at Google. Peterson claims that Google delegated payroll to Eurest and then to Mainelli.

Mainelli provides HVAC, and plumbing services to commercial construction projects.  Google declined to comment on the lawsuit and a Mainelli spokesperson was unavailable for comment.

Wage lawsuits are becoming common, as AT&T, Electronic Arts, IBM, Apple and Google have all been involved in high dollar compensation lawsuits in the past five years.
