Judges Scheduled to Hear Zimmer NexGen Consolidation Arguments

The  U.S. Judicial Panel on Multidistrict Litigation will hear arguments on July 28, 2011 regarding consolidation of Zimmer NexGen knee replacement lawsuits into multidistrict litigation (MDL), after plaintiff Fred Stone filed a request to centralize the Zimmer NexGen litigation for pretrial proceedings before Judge Joan Lefkow in the U.S. District Court for the Northern District of Illinois.

Most of the lawsuits have been filed in regards to the and Zimmer NexGen LPS devices, the Zimmer NexGen CR-Flex implants, and the Zimmer NexGen MIS components.

At the time of the request, 28 lawsuits had been filed in 13 separate federal courts across the country, however, attorneys for the plaintiffs have opined that hundreds more are soon likely to be filed.

All lawsuits filed thus far involve allegations that the Zimmer NexGen knee replacement system has design defects that have caused failures and injuries which have sometimes lead to risky, complex revision surgery.
