Judge To Decide Who Leads DePuy’s Pinnacle MDL

On August 10, Judge Kinkeade, who has never presided over an MDL, issued an order calling for plaintiff law firms to respond to a long list of questions regarding big case experience. The Judge also said he might conduct interviews before deciding who will lead the DePuy Pinnacle hip implant MDL.

Johnson & Johnson subsidiary DePuy is already in the midst of multidistrict litigation over the ASR hip replacement devices. J&J recalled the DePuy ASR hip replacement devices last year, and is facing over 2,000 lawsuits.

Attorneys involved in the MDL have said that they believe Johnson & Johnson is going to fight hard in the Pinnacle litigation, where unlike the ASR system, some products have polyethylene or ceramic liners between the metal parts. One of the biggest issues in ASR litigation is that the metal-on-metal devices shed tiny metallic particles that can cause blood poisoning, and damage to local tissue.

Nearly 300 personal injury lawsuits have been filed against DePuy’s Pinnacle alleging the company failed to warn consumers about design defects. No recall has been issued for Pinnacle hip replacement devices.
