Judge Seals Witness Order In Yaz, Yasmine MDL

U.S. District Judge David Herndon, who is seeing the federal Yaz and Yasmin litigation, sealed his decision on the court’s jurisdiction over Bayer’s European executives. Yesterday, he resolved a dispute regarding the necessity of Bayer to produce the European Exec’s for deposition regarding the oral contraceptives, after Bayer asked him to bar depositions regarding individuals identified only as van der Werff, Riemann and Trudeau, the Madison Record has reported.

The Multidistrict Litigation of Yaz, Yasmine and the generic version of the oral contraceptives known as Ocella concern allegations that the medications damage gall bladders and blood vessels increasing the risk of serious side effects, including blood clots and sudden death.

The Madison Record reported that under Dutch law Bayer can not force van der Werff to testify, and that Susan Weber of Chicago wrote that van der Werff has stated he will not voluntarily testify. She also said that if the plaintiffs want to pursue his deposition, they will have to follow procedures set forth by the Hague Convention.

Weber also wrote that Riemann has no specialized knowledge that would “demonstrate plaintiffs’ need for his deposition.” She also wrote that evidence does not show that Trudeau has specialized knowledge that would warrant his deposition.
