Illinois Class Action Lawsuit Filed Against Avandia

A class action lawsuit has been filed in St. Clair County Circuit Court against GlaxoSmithKline (GSK), SmithKline Beecham Corporation, McKesson Corporation and five other defendants by Melvin Reagan on behalf of 43 patients alleging that the diabetes drug Avandia caused heart problems.

The class action claims that GSK received Food and Drug Administration approval and begin marketing the Type-2 diabetes medication in 1999. In 2005, test performed by the manufacturer showed the side effects of Avandia included an increased risk of heart problems including heart attack and congestive heart failure, but did not warn consumers of the increased risks until 2007.

The class action lawsuit accuses the defendants of negligence, fraud, breach of warranty and misrepresentation, and says that Avandia has been prescribed to nearly 6 million patients in the U.S. alone since its FDA approval.
