Fosamax Trials Scheduled For February

On November 1, 2011, the Honorable Carol E. Higbee who is overseeing Fosamax litigation in the Superior Court of New Jersey, Atlantic County, has issued a Case Management Order regarding four Fosamax lawsuits that allege the drug causes osteonecrosis of the jaw.

Fosamax side effects include femur fracture and osteonecrosis of the jaw, and both types of lawsuits have been consolidated into one mass tort action. Judge Higbee has now ordered that the lawsuits regarding osteonecrosis of the jaw will proceed to trial on February 27, 2012. Judge Higbee also detailed the deadlines that the plaintiffs and the defendant, Merck, must adhere to, including that expert reports be turned over by November 4, 2011 and December 5, 2011. The Order also states that depositions and expert discovery must be completed by January 9, 2012.

Trials for lawsuits filed over Fosamax femur fractures will follow the osteonecrosis trials.

Fosamax is a medication used in the treatment and prevention of osteoporosis. On October 13, 2010, the US Food and Drug Administration issued a warning regarding the association of atypical thigh bone fractures in patients who take bisphosphonates like Fosamax for longer than five years.
