Former NYPD Officer to Receive Enhanced Disability Pension

A retired New York Police Department (NYPD) officer who developed fibromyalgia and other health conditions after working at Ground Zero will receive an enhanced disability pension after a five-year legal battle. The Appellate Division in Manhattan overturned a lower court ruling which had found that her health problems were not caused by her exposure to toxic substances while working at the site of the fallen World Trade Center (WTC) towers.

Court documents show the police officer began to experience dizziness, shortness of breath, nausea and chest pains shortly after she started working at Ground Zero, where she was stationed at a security post for two months following the September 11, 2001 terror attacks. The New York Daily News reported that the former cop joined the NYPD in 1998. In 2002, the police officer was diagnosed with fibromyalgia, asthma, chronic fatigue syndrome and acid reflux, as well as toxic levels of heavy metals (cadmium, lead and mercury).

The Police Pension Fund and a lower court had rejected her claims that her illnesses were caused by exposure to the toxic fumes and dust swirling around the WTC site. The appellate judges disagreed and stated that the Pension Fund had provided no credible evidence to support its decision. The police officer provided evidence of the link between heavy metal toxicity and fibromyalgia in the form of studies, and the judges ruled that fibromyalgia qualifies as a “new onset disease” because the officer had not suffered from the condition before her work at the WTC, according to court documents.

The enhanced disability pension will add another $2,400 or more monthly to assist the former police officer support her family, court documents show. Under the normal disability pension, she received only half of her most recent salary, and that amount was taxed. Accident disability pensions provide three-quarters salary and are not taxed.
