Florida Lawsuit Filed Against Dial Complete

A class action lawsuit has been filed in a Miami Division Florida District Court against the Dial Corporation for deceptive and unfair claims, breach of contract, breach of express warranty, unjust enrichment, tortious breach of warranty, negligent design and failure to warn.

The lawsuit claims that Dial promotes and sells Dial Complete products that contain Triclosan, a chlorophenol, has been listed in a class of chemicals suspected of causing cancer in humans, and which the Environmental Protection Agency (EPA) has registered as a pesticide and rated as having high human health and environmental risks.

The lawsuit also states that some of the claims the Dial Corporation advertises and markets are deceptive and have no “independent, competent and reliable support for these claims.”

Plaintiffs are seeking “ restitution, disgorgement, actual, statutory and punitive damages, and attorneys’ fees and costs, including pre-judgment and post-judgment interest thereon; and a temporary, preliminary and permanent order for injunctive relief to prevent the Dial Corporation from continuing to engage” in the unfair business practices alleged.
