Florida Lawsuit Against “Trump”Developments Proceeds

Even though attorneys for Donald Trump argued that a lawsuit filed against him in Florida should be tossed out stating that agreements signed by the plaintiffs disclosed Trumps role as a licensor not a developer, Judge Adalberto Jordan of the Southern District of Florida disagreed.

The lawsuit, brought by buyers who purchased what they thought were Trump properties, claims plaintiffs lost hundreds of thousands of dollars in deposits when the building projects encountered financial trouble, were never finished, and Trump pulled his name from the projects. 

Buyers  thought the apartments they were purchasing were being developed by Trump, partly because in marketing materials, Trump called the Trump International Hotel and Tower Fort Lauderdale, “my latest development “ and letters announcing that  “we have commenced construction” were signed by Trump. The plaintiffs say they had no idea that Trump was not a developer, but had instead licensed use of his name of his name to the project developers.

In his decision regarding the Florida lawsuit, Judge Jordan noted that Trump presented himself as part of the team of developers for the project, and that “through advertising brochures, these defendants call themselves developers.” He also stated that a buyer, “could have believed that alleged misrepresentation.”  The lawsuit,  filed by more than 300 buyers will proceed to the next stage.
