Five Hip Replacement Surgeries In Four Years Prompt Lawsuit Against DePuy

Jane Rogers of Creedmoor, Texas, is one of the 93,000 patients affected by the recall of ASR XL Acetabular System and its ASR Hip Resurfacing System made by DePuy Orthopaedics of Warsaw, Ind.  She is also one of more than 1,000 U.S. patients who have filed lawsuits against DePuy.

Rogers, who has undergone five hip surgeries and missed weeks of work, had her hips replaced in 2007 and 2008. In 2010 she had one hip removed due to problems, and had the other removed a year later. The fifth surgery was for a temporary hip placement.

Rogers lawsuit, like many others, claims premature failure of the devices, which according to the FDA can release chromium and cobalt debris damaging surrounding bone and tissue as well as cause problems in the heart, thyroid gland and nervous system. Her lawsuit also claims that DePuy knew of the high failure rate of these products for years before initiating the recall. In fact, Rogers feels that DePuy knew about the problems before she had her second surgery in 2008.

DePuy issued a statement saying “We believe we made the appropriate decision to recall at the appropriate time given the available information.
