Fifth Lawsuit Filed Against American Pistachio over Tainted Pine Nuts

Five Rochester, New York, families have filed lawsuits against American Pistachio Commodities Corp, over salmonella tainted pine nuts that have sickened at least 42 people across six states. The most recent lawsuit, filed by Laurie Neff in U.S. District Court in Rochester, claims that her and her daughter suffered severe gastrointestinal illness from salmonella poisoning from the nuts.

In October, Wegmans Food Markets announced it was recalling nearly 5,000 pounds of pine nuts purchased from American Pistachio, dba Sunrise Commodities, and sold in the bulk food sections of its stores. Neff purchased the tainted pine nuts at Wegmans in October. She became sick after consuming them, while her daughter became sick in early November and had to be hospitalized. The lawsuit says the daughter either became sick from consuming the nuts or through contact with her mother.

The Neff’s attorney said American Pistachio Commodities failed at its duty to ensure its products were safe, the Democrat and Chronicle reported. “All you’ve got to do is test the food before you release thousands and thousands of pounds on a hungry nation. How hard is that?” he said.
