Medical Mapractice Lawsuit Filed Ater Mother Dies from Botched C-Section

The estate of Kelly Casstevens Jarvis has filed a medical malpractice lawsuit in Surry Superior Court, North Carolina, against Dr. Peter F. McIlveen and High Chatham Memorial Hospital alleging Jarvis’ death was caused by negligence. Total Woman Care and Alliant Management Services Inc., are also named as defendants in the lawsuit.

According to the lawsuit, McIlveen severed Jarvis’ small bowel while performing a cesarean section. Jarvis, 31, suffered bowel pains and other symptoms that were ignored by McIlveen and hospital staff, which caused her to die five days after giving birth. “Her death was completely avoidable with proper medical care,” the Mount Airy News reported the lawsuit as saying.

The lawsuit alleges that McIlveen “created an emergency situation as a result of his negligence, and then failed to take emergency action to avoid the death of Kelly Casstevens Jarvis,” by ignoring complaints about severe abdominal pain, nausea, and not being able to have a bowel movement for three days. She was released from the hospital without any testing to determine the reason for her pain and her other complaints. The suit also claims that Jarvis was admitted back into the hospital the next day, where tests determined her kidneys were shutting down. She was placed in intensive care, while waiting to be transferred to Wake Forest Baptists Health hospital in Winston-Salem. It took the transport team an excessive amount of time to arrive, and Jarvis was declared dead less than two hours later.

The lawsuit seeks compensatory damages for funeral expenses, lost wages, pain, suffering, and punitive damages for willful and wanton conduct.
