The parents of Owen Caldwell have filed a lawsuit in Hennepin County District Court in Minnesota, against dairy farmer Michael Hartman alleging he sold raw milk products contaminated with E. coli, which caused Owen, who was age two at the time, to develop Hemolytic Uremic Syndrome, a potentially fatal kidney condition.

An investigation by the Minnesota Department of Agriculture found that Hartman was selling unpasteurized milk products that sickened over 12 people.

According to the lawsuit, Owen was treated with kidney dialysis after becoming ill as the result of the careless negligence of Hartman and employees. “Owen, became extremely sick and was in the hospital for a couple of weeks, and was very close to death,” said an attorney representing the Caldwells.

Michael Hartman, whose farm is near Gibbon, Minnesota, said that he will contest the allegations in court. The trial is scheduled to begin during the first week of November.

The lawsuit seeks damages of over $50,000 in medical and additional costs.
