Employees File Wage Lawsuits Against Lee Memorial Health System In Wage Dispute

Nurse Joni Markerson and security guard Steve Kersey have filed wage lawsuits against Lee Memorial Health System alleging LMHS failed to pay them and others their fair share in overtime wages because of an automatic 30-minute meal deduction for each shift, even if no meal break was taken.

An attorney for the plaintiffs said that “Other current and former employees have also come forward to participate in the overtime litigation against Lee Memorial Health System to seek the recovery of their earned but unpaid wages, and a large number of employees regularly worked in excess of 40 hours per week without being fully compensated for their actual hours worked because of LMHS’ automatic deductions.” He has requested class action status, saying that hundreds, if not more than one thousand current and former employees are eligible to join their complaints.

Spokeswoman Mary Briggs released a statement on behalf of Lee Memorial Health System saying, ““We have a number of policies and practices in place in order that employees are compensated for all time worked. Lee Memorial Health System denies the allegations raised in the complaints and will vigorously defend these actions.”

The lawsuits seek back pay, damages and attorney’s fees.
