DuPont Offers Compensation For Trees Damaged By Imprelis

DuPont Co., is contacting lawn care professionals and golf course superintendents with the details of a claims resolution process. Property owners who waive their rights to sue will be eligible for payments above the offered removal and replacement costs of trees killed by the herbicide Imprelis, as well as replacement costs for trees damaged by the chemical that do not recover by June 2012.

The emailed claims resolution information was sent on the same day DuPont filed papers in federal court regarding the Delaware consolidated case of six lawsuits against the company.

More than 40 other Imprelis lawsuits are seeking class-action status in more than 12 states. A federal panel will consider consolidation of those lawsuits to a single district on September 27.

The Star Tribune reports that the EPA stated DuPont submitted more than 7,000 adverse incident reports connected to Imprelis last month. DuPont said in the papers filed in the Delaware consolidation that the number of reports is “relatively limited” and involve less than 10 percent of the properties on which Imprelis was applied.

The EPA says that Imprelis may have been misbranded, as label direction and warnings are inadequate to  protect plant species not targeted by the weed killer.
