DePuy Orthopaedics ASR Hip Implant MDL Status Conference Ordered

Judge David A. Katz has ordered a May 1, 2012 status conference with the court appointed committee to coordinate DePuy Orthopaedics, Inc. ASR hip implant multidistrict litigation currently underway in the U.S. District Court for the Northern District of Ohio.

Judge Katz vacated a previous status conference for March 15, saying “discovery is proceeding apace which negates the necessity,” instead holding a telephone conference where he requested a meeting between lead counsel to discuss issues regarding bellwether trials and ordered lead counsel to submit a joint proposal of bellwether trial selection protocols by April 27, 2012.

DePuy, a subsidiary of Johnson & Johnson, issued a recall of 93,000 ASR hip replacement devices in August 2010, including the ASR Acetabular System, and the ASR Hip Resurfacing System, after researchers discovered that an abnormally high number of the devises prematurely failed causing patients to undergo risky revision surgery.

DePuy is currently facing liability lawsuits over its Pinnacle hip implant system in multidistrict litigation underway in U.S. District Court for the Northern District of Texas.
