DePuy Faces Another Metal Hip Replacement Lawsuit

A lawsuit has been filed by Delores Hatcher against Johnson & Johnson and DePuy after a its Pinnacle device,a  metal-on-metal implant, caused severe pain and caused high levels of meta-cobalt and chromium-1 in her blood.  The lawsuit also claims that DePuy and Johnson & Johnson concealed the defects of the hip replacement devices.

DePuy has recalled more than 90,000 of the similar ASR hip replacement devices due to early failure and metal toxicity. DePuy’s Pinnacle and ASR hip replacement devices bypassed the Food and Drug Administration premarket-approval testing process because the company claimed the devices were “substantially equivalent” to earlier, approved devices.

Numerous individual and class action lawsuits have been filed against Johnson & Johnson, DePuy and other manufacturers of metal-on-metal hip replacement devices because  of the dislocation, disarticulation, high failure rates and metal ion leakage that may cause tissue loss, bone damage and toxicity.

The lawsuit also alleges unjust enrichment, as the U.S. Attorney’s Office has charged both Johnson & Johnson and DePuy of paying illegal kickbacks to doctors and hospitals while marketing the defective metal hip replacements.
