Del Monte Fresh Files Notice Of Intent to Sue Oregon Public Health

Del Monte Fresh Produce N.A., a subsidiary of Fresh Del Monte Produce Inc., has filed a notice of intent to sue the Oregon Health Authority Public Health Division and a health official, because of its conduct and misleading allegation that Del Monte Fresh imported cantaloupes were the source of a Salmonella outbreak, even though the agency had no sufficient factual basis to make those claims.

In a press release, Del Monte Fresh announced, “[t]he FDA investigation ultimately found no connection between Del Monte Fresh cantaloupes and any cases of Salmonella Panama, including in Oregon,” the company says. “FDA issued a notice ending the recall on July 29, 2011.”

The news release went on to say that “Del Monte Fresh’s cantaloupes are farmed, processed, transported, and stored under state-of-the-art food safety controls that far exceed FDA regulatory requirements.”
