County Sues The Binghamton University and BU Foundation Over Fracking Documents

Broome County, New York has filed a lawsuit against Binghamton University and the BU Foundation after the Foundation refused to release documents related to the lease of 563 acres of land owned by the University to Chesapeake Appalachia, a brand of Chesapeake Energy.

The documents requested by Broome County include information pertaining to what stipulations were included in the lease regarding environmental protection procedures that must be maintained while fracking.

Currently, there is a moratorium on hydraulic fracturing in the state of New York, pending a review by the Department of Environmental Conservation, to determine the effects of hydraulic fracturing on the environment and public health.

According to the Press & Sun Bulletin, Broome County has made several requests for the documents, citing the state’s Freedom of Information Law. The Foundation, a separate legal entity from the University, manages the University finances. The Foundation says that because it is a non-profit corporation, and not a state agency, it is not subject to the FOIL law.
