Connecticut Jury Awards $58 million In Medical Malpractice Suit

In Connecticut, the family of eight-year-old Daniel D’Attilo was awarded $58 million, the largest award in the state’s history, in a medical malpractice suit after determining the boys medical problems were preventable.

The lawsuit claimed that Dr. Richard Viscarello and Maternal-Fetal Care ignored complications and failed to deliver Daniel early, and the C-section delivery was done improperly and cut off oxygen to Daniel’s brain. Attorneys for the defendant say that Daniel’s injuries were caused by an undetected infection while in the womb.

Daniel’s mother Cathy said “The dollar amount means he will be taken care of, that’s what this means to us.”  Daniels ever increasing stack of medical bills has caused his parents to fall behind on their mortgage, and their house is being foreclosed on. They hope they will be able to stay in the home because Daniel is comfortable there, but lawyers for the physician have said they are going to appeal the verdict, which means it could be years before the family will receive any of the award, if they ever do. Of his disabilities, Daniels father said the boy “got his life taken away from him, and the only form of justice is this.”
