Class Action Lawsuit Filed Against Abercrombie & Fitch over Gift Card Expiration

A class action lawsuit has been filed against Abercrombie & Fitch Stores Inc., on behalf of the citizens of Ohio who participated a gift card promotion in the last two years and who loss funds because of an expiration date on cards that indicated no expiration date.

According to the class action lawsuit, Abercrombie & Fitch advertised a promotion in Ohio that promised that for every $100 of merchandise purchased, the purchaser would receive a non-expiring Abercrombie & Fitch gift card worth $25. The cards were voided the following month, and all credit was eliminated.

The lawsuit alleges the clothing retailer breached a contract and acted in violation of the Ohio Consumer Sales Practices Act, when it voided the cards before five years, which is illegal.

The lawsuit seeks punitive and compensatory damages, attorney’s fees and other relief.
